Brookline Town Clerk vs. Probate and Family Court

The Brookline Town Clerk does not hold dissolution of marriage records. Brookline is legally a town rather than a city, and the Town Clerk serves the same function as a city clerk elsewhere. The clerk's office handles vital records only. That means births, marriages, and deaths that occurred in Brookline. No divorce filings, case records, or court judgments are kept at Brookline Town Hall.

Certified copies of vital records from the Town Clerk cost $15 per copy. Amendments cost $50. If you need a marriage certificate as part of your dissolution of marriage case, the Town Clerk can provide that. But the divorce itself is handled entirely by the Norfolk County court.

One thing that surprises some Brookline residents: because Brookline is in Norfolk County and not Suffolk County, your dissolution of marriage case goes to Canton, not to Boston. Even though Boston is next door, the Suffolk County court has no jurisdiction over Brookline cases. The Norfolk County Probate and Family Court in Canton is the right place.

Filing Fees and Process for Brookline Residents

Dissolution of marriage in Massachusetts is governed by M.G.L. Chapter 208. The process and fees are the same at every Probate and Family Court in the state. Brookline residents follow the same rules as everyone else.

A joint petition under M.G.L. c. 208, § 1A requires both spouses to agree on all terms of the dissolution. You must file a signed separation agreement with the petition. The fee is $215. A complaint for divorce under M.G.L. c. 208, § 1B is used when only one spouse files or when both parties disagree on terms. That costs $280. A $15 surcharge applies to most filings. Certified copies of judgments and decrees cost $20 each.

Pay by attorney's check, money order, bank certified check, or cashier's check. Make it out to "Commonwealth of Massachusetts." The court does not take personal checks. Under M.G.L. c. 208, § 5, residency requirements must be met before filing. If the cause for divorce arose outside Massachusetts, at least one spouse must have been a state resident for a full year. Brookline residents who meet this rule can file right away at the Norfolk County court in Canton.

Nisi Period: A dissolution of marriage in Massachusetts is not final at the time of judgment. Joint petition (1A) cases carry a 120-day nisi period. Contested (1B) cases carry a 90-day waiting period. Under M.G.L. c. 208, § 21, the divorce becomes absolute only after the nisi period ends. Neither party can remarry before that point.

Property division is addressed under M.G.L. c. 208, § 34. The court considers many factors, including the length of the marriage, each spouse's income and assets, and contributions to the household. Alimony is covered under M.G.L. c. 208, § 37. If you cannot afford the filing fee, ask about an Affidavit of Indigency when you arrive at the court. A judge can waive fees for qualifying residents.
