Fees for Dissolution Records and Filings

Barnstable County uses the same statewide fee schedule as every other Massachusetts Probate and Family Court. Fees do not vary by county. What you pay depends on the type of dissolution case.

A joint petition under M.G.L. c. 208, § 1A costs $215. A complaint for divorce under M.G.L. c. 208, § 1B costs $280. The court adds a $15 surcharge and a $5 summons fee. Service by sheriff or constable costs an additional $50 to $75. Online filing through eFile carries a $22 case management fee on top of the base fee.

Certified copies of the dissolution judgment are $20 each. You need a certified copy for name changes, updating financial accounts, and other legal purposes. Plain copies cost less but are not always accepted. The court does not accept personal checks. Pay by attorney's check, money order, bank-certified check, or cashier's check made payable to "Commonwealth of Massachusetts."

Barnstable County Dissolution Of Marriage Filing Process

Every dissolution of marriage filed in Barnstable County follows Massachusetts state law under M.G.L. Chapter 208. The steps you take create documents that become part of the public court record.

Before you can file, you need to meet the residency rule. Under M.G.L. c. 208, § 5, if the reason for dissolution happened outside Massachusetts, one spouse must have lived in the state for at least one full year before filing. If the grounds occurred inside Massachusetts, you can file right away. You must file in the county where you or your spouse lives. If you live in any of the 15 Cape Cod towns, your case goes to Barnstable.

Two no-fault options exist for couples who want to end a marriage without contested proceedings. A joint petition under M.G.L. c. 208, § 1A is filed by both spouses together. Both must agree on all terms, sign a separation agreement, and appear at a short hearing. The judge reviews the agreement and, if satisfied, enters the judgment. That judgment then sits in a 120-day nisi period before the dissolution becomes absolute. A complaint under M.G.L. c. 208, § 1B is filed by one spouse alone. The other spouse must be served. This path takes longer and often involves more hearings. After judgment, the 1B nisi period is 90 days.

Nisi Period Reminder: A judgment of divorce nisi is not the final step. The dissolution only becomes absolute after the nisi period ends: 120 days for joint petitions and 90 days for complaints. During that window, either party can petition to revoke the judgment under certain conditions.

Financial statements filed in all cases involving assets or support are automatically impounded under Trial Court Rule 401. They are not part of the public record. The rest of the file is open. Under M.G.L. c. 208, § 34, courts weigh 15 factors when dividing marital property. Those findings show in the judgment. Alimony terms, if any, fall under M.G.L. c. 208, § 21. Courts can also enter temporary orders under M.G.L. c. 208, § 37 to cover support or custody while the case is pending.
