Framingham City Clerk vs. Probate Court

This is one of the most common points of confusion for Framingham residents looking for records. The City Clerk and the Probate and Family Court are completely separate offices that hold different types of records. You cannot get a dissolution of marriage record from the City Clerk.

Filing Fees and Copy Costs

Under M.G.L. c. 208, § 1A, a joint petition for dissolution costs $215. Both spouses file together and must have a signed separation agreement. Under M.G.L. c. 208, § 1B, a complaint filed by one spouse costs $280. Additional fees such as a $15 surcharge, a $5 summons fee, and a $15 citation fee may also apply depending on your case.

Certified copies of dissolution judgments cost $20 each. The court requires payment by attorney's check, money order, or bank certified or cashier's check. All payments must be made out to "Commonwealth of Massachusetts." The court will not accept personal checks under any circumstances. If you cannot afford the fees, you can ask the court for a fee waiver by filing an Affidavit of Indigency. The judge reviews your income and decides if you qualify.

Massachusetts Dissolution of Marriage Law
