Malden City Clerk vs. Probate and Family Court

Many people assume the Malden City Clerk handles divorce records. That is not the case. The City Clerk only keeps vital records for events that happened within city limits. That means birth, marriage, and death records. Dissolution of marriage is a court matter, not a city function, so the City Clerk has no divorce files, no case records, and no judgments. If you go to City Hall asking for a divorce record, staff will direct you to the probate court in Cambridge.

The Malden City Clerk is located at City Hall, 215 Pleasant Street, Room 220. Phone: (781) 397-7116. If you need a certified copy of a marriage certificate before or after your dissolution of marriage case, you can get that from the clerk. The clerk also handles business certificates and dog licenses. Hours are Monday, Wednesday, and Thursday from 8:00 AM to 5:00 PM, Tuesday from 8:00 AM to 7:00 PM, and the office is closed on Friday. For your dissolution of marriage case, the only place that matters is the Middlesex County Probate and Family Court. That court holds all filings, all hearing records, and all final judgments for Malden residents. Copies of the divorce decree come from the court, not from the city.

Filing Fees and Copy Costs

Massachusetts sets filing fees for dissolution of marriage at the state level. Every Probate and Family Court location charges the same amounts, including Middlesex County in Cambridge. The fee you pay depends on how you file.

A joint petition under M.G.L. c. 208, § 1A costs $215. Both spouses must agree on all terms and sign a separation agreement. A complaint for divorce under M.G.L. c. 208, § 1B costs $280. That route applies when only one spouse files or when the parties do not agree. Additional court costs include a $15 surcharge, a $5 summons fee, and a $15 citation fee where applicable. Certified copies of a divorce judgment cost $20 each.

The court accepts attorney's checks, money orders, bank certified checks, and cashier's checks made out to "Commonwealth of Massachusetts." Personal checks are not accepted. If you cannot afford the fees, you may file an Affidavit of Indigency asking the court to waive costs. A judge reviews the request and decides based on your income and assets.

Nisi Period: A Massachusetts dissolution of marriage does not take effect the moment a judge signs the judgment. Joint petition (1A) cases have a 120-day nisi period. Contested (1B) cases have a 90-day nisi period. The divorce becomes final only after this waiting period ends. See M.G.L. c. 208, § 21.

Under M.G.L. c. 208, § 5, at least one spouse must have lived in Massachusetts for one year before filing if the cause for divorce arose outside the state. If both parties lived in Massachusetts when the grounds arose, there is no minimum residency period. Malden residents who have been in the state long enough can file right away.
