Under M.G.L. c. 208, § 5, one spouse must meet the state residency requirement before filing. If the grounds for divorce happened outside Massachusetts, that spouse must have lived in the state for at least one year. Lynn residents who have been in the state for a year can file in Essex County.

Filing for Dissolution of Marriage from Lynn

All dissolution of marriage filings for Lynn residents go to the Essex County Probate and Family Court under M.G.L. Chapter 208. The law provides two paths. A joint petition under § 1A works when both spouses agree on all terms before filing. A complaint under § 1B is for cases where only one spouse wants the divorce or the parties cannot agree.

A joint petition requires both spouses to sign a separation agreement. The agreement must cover property, debts, and, if children are involved, custody and child support. File it with the petition at the Salem court. The filing fee is $215. A hearing is scheduled after the court accepts the paperwork. When the judge approves the agreement, a judgment nisi enters. Under § 21, the divorce is final 120 days after that.

Nisi Period: A Lynn dissolution of marriage does not become final the day the judge rules. A 1A joint petition waits 120 days after the nisi. A 1B contested case waits 90 days. You are not legally divorced until the nisi period ends.

Filing a complaint for divorce (1B) costs $280. The filing spouse must serve the other through a constable or deputy sheriff. Discovery may follow. A contested divorce hearing cannot be held until at least six months after the complaint is filed. Property division is decided under § 34, which gives the judge wide discretion based on many factors including the length of the marriage, each spouse's income, and contributions to marital property.

All official court forms are free at mass.gov. Download and complete them before traveling to Salem. Showing up with incomplete paperwork means another trip. Financial statements are required and are automatically impounded, so they do not become part of the public record.

Lynn residents filing without a lawyer should complete all required forms before going to the court. The court cannot give legal advice, but court staff can tell you if a form is missing or incomplete.
